the fundaframe terms & conditions
at fundaframe we believe more in TLC than in T&Cs, but just to be sure everybody knows what's what, here are our very simple terms & conditions spelled out, not so much in small print as in bold and plain:
1 fundaframe.org (’fundaframe’) is a website (’the website’) which allows filmmakers (’the filmmakers’) to pitch (’propose’) their picture (’film’, ‘project’, ‘film project’) to the people (any person, company or other body that is recognised as a legal entity), so that anybody who wants to can fund (pay for) one or several analogue or digital cinema / video frames in the proposed film projects; anybody funding frames in this way thus being a ‘framefunder’
2 in return for their funding, framefunders are promised certain benefits and/or services and/or digital, virtual or manifest products which are specified by the filmmakers on the pages outlining their project on this website; fundaframe publishes these on behalf of the filmmakers and does not in any way guarantee or take responsibility for the delivery, completion or fulfilment of any such promise, the responsibility for their fulfilment lying solely with the filmmakers, whereby neither the filmmakers nor fundaframe convey or imply to convey that any rights or titles in the frames so funded or in any other part of the proposed project is to pass to the framefunder; it is stated explicitly herewith that funding one or several frames through fundaframe does not entitle the framefunder to any rights in any part of the proposed project whatsoever
3 fundaframe assures and confirms that it has discussed the project proposed on this website with the filmmakers and accepted it in good faith with good reason to believe that the filmmakers are in a position to realise their project with the funding sought from framefunders, but fundaframe does not give any guarantee or undertaking as to the nature, quality, production values or any other aspect of the proposed project, nor does fundaframe vouch for any of the credentials of the filmmakers; all the opinions, views, portrayals and characterisations in any proposed project are those of the filmmakers alone; fundaframe does not accept responsibility or liability for any content proposed on or funded through fundaframe
4 by proposing their project on this website, the filmmakers assert that their project is at an advanced stage of development and is ready to go into production pending funding; the filmmakers undertake to commence principal photography within two years of the project ‘going live’ (accepting funds from framefunders) on this website, failing which fundaframe will return to the framefunders all funds received after deduction of any third party fees and charges such as but not restricted to those charged by paypal or any other handling agency for the processing of payments received on behalf of filmmakers
5 the filmmakers agree and commit themselves to using all and any funds raised through fundaframe for the sole purpose of making the project proposed on this website and to keep fundaframe up to date with progress on the proposed project throughout its creation and until all obligations to its framefunders have been met; in particular, filmmakers will inform fundaframe of any material and significant change or departure from the proposed project while fundaframe will undertake to keep the website up to date and framefunders informed of any developments
6 by proposing their project on this website, the filmmakers agree to these terms and conditions and indemnify fundaframe against any liability arising through or resulting from publishing content and information on their behalf and/or from collecting and processing monies on their behalf; the filmmakers agree that fundaframe will collect money (’funds’) on their behalf and hold it in escrow until the filmmakers declare themselves ready to go into production at which time fundaframe will pay out all monies raised on their behalf after deduction of any third party charges or fees such as but not restricted to paypal or any similar handling agency for processing online payments and after deduction of a commission charged by fundaframe for the running and maintenance of this website, the level of which may vary from time to time but will remain the same for any project for the duration of its being ‘live’ on this website (funds being collected for it); the fundaframe commission currently stands at 3.5% of the net funding received
7 by funding frames through this website, framefunders agree to these terms and conditions and indemnify fundaframe against all and any liability arising through or resulting from their funding of frames in any proposed project
